Excavation Service Agreement

This Excavation Service Agreement governs all excavation, mini excavation, site preparation, and related services performed by All Canadian Bin Rentals Ltd. ("we", "us") for you ("you", "Client"). Please read it carefully before accepting your quote.

1. Acceptance

By accepting your quote — whether by email reply, written confirmation, electronic acceptance, or commencement of work — you confirm that you have read, understood, and agreed to be bound by this Agreement and the All Canadian Privacy Policy.

2. Scope of Work

The scope of work is defined in the written quote we provide to you. Any work performed outside the original scope ("Change Order") is quoted separately and is not included in the original price. Verbal change requests must be confirmed in writing (email or text) before additional work begins.

Common services covered under this Agreement include:

  • Mini excavation and digging
  • Trenching for utilities, drainage, or irrigation
  • Site preparation and grading
  • Demolition of small structures
  • Material loading, hauling, and disposal
  • Backfilling and compaction

3. Quotes & Pricing

Quotes are valid for 30 days from the date issued unless otherwise noted. Pricing is based on:

  • The scope of work described in the quote
  • Site conditions as described or observed during a site visit
  • Standard soil/material conditions

If actual site conditions differ materially from those quoted (for example unexpected rock, hazardous material, buried obstructions, or high water table), additional charges apply at our standard hourly rates and are communicated to you before work continues where reasonably possible.

All prices are in Canadian dollars (CAD) and subject to 5% GST.

4. Site Access & Preparation

You are responsible for:

  • Providing safe, legal, and unobstructed access to the work site
  • Identifying and marking the location of all underground utilities, septic systems, irrigation lines, sprinklers, and private services before work begins
  • Obtaining all necessary permits and approvals (unless we have agreed in writing to handle these)
  • Removing or relocating personal property, vehicles, and obstacles from the work area
  • Notifying neighbours where work may affect their property or access

Before any excavation, you must contact BC One Call (1-800-474-6886) to identify public utilities. We may also place a BC One Call request as a courtesy, but this does not relieve you of your responsibility to identify private utilities and services not registered with BC One Call.

5. Underground Utilities & Hidden Conditions

We are not liable for damage to unmarked or improperly located underground utilities, irrigation systems, septic fields, drainage tiles, or any private services that were not clearly identified by you or BC One Call before work began.

If hidden conditions are discovered during work that materially affect cost, schedule, or feasibility — including but not limited to rock, contaminated soil, asbestos, buried debris, or unmarked utilities — work may pause and we will notify you. Additional costs to address such conditions will be quoted and require your approval before continuing.

6. Property & Site Damage

Excavation work involves heavy equipment and inherent risk to surrounding surfaces. You acknowledge that some impact to lawns, driveways, landscaping, and access routes is unavoidable. We exercise reasonable care to minimize damage but are not liable for:

  • Wear, ruts, or compaction on lawns or unpaved surfaces
  • Cracking or marking of driveways, patios, or pavers caused by equipment weight in normal operating conditions
  • Damage to fragile landscaping, irrigation, or surfaces not identified by you before work began
  • Damage to underground utilities or services not properly marked

Restoration of the site beyond rough backfill (e.g. sod, paving, landscaping) is not included unless specifically listed in the quote.

7. Scheduling & Weather

Scheduled start dates are estimates and subject to weather, equipment availability, prior job overruns, and conditions beyond our control. We reserve the right to reschedule work due to unsafe conditions including heavy rain, frozen ground, high winds, or equipment failure. We provide reasonable notice of any rescheduling.

Client-caused delays (site not ready, permits missing, change requests) may result in standby charges at our standard hourly rate.

8. Payment Terms

Standard payment terms are as follows unless specified otherwise in your quote:

  • Deposit: 25–50% of the quoted total may be required to schedule work, particularly for jobs over $2,500 or for materials and permits
  • Progress payments: may apply on multi-day projects
  • Final balance: due upon completion of work, payable by e-transfer, credit card, or cheque

Invoices not paid within 30 days are subject to interest at 2% per month (24% per annum). You are responsible for all costs of collection, including legal fees.

9. Cancellations

Cancellations made more than 7 days before scheduled start: full refund of deposit, less any costs already incurred (permits, materials ordered).

Cancellations made within 7 days of scheduled start: deposit may be forfeited to cover scheduling, mobilization, and lost work commitments.

Cancellation after work has begun: you are responsible for all work performed to date plus any demobilization costs.

10. Insurance & Liability

We carry general liability insurance and WorkSafeBC coverage for all employees and operators on site. Proof of insurance is available on request.

Our total liability under this Agreement is limited to the amount you paid for the specific work in question. We are not liable for indirect, consequential, incidental, or special damages, including lost profits, lost use, or delays in unrelated work.

You agree to indemnify and hold us harmless from any third-party claims arising from misrepresentation of site conditions, failure to identify underground utilities, or unauthorized access to the work site.

11. Disposal of Excavated Material

Disposal of excavated material at a licensed facility is included only if specifically stated in the quote. By default, excavated material remains on-site for you to manage. Disposal of contaminated soil or hazardous material is never included in standard quotes and requires separate arrangement at additional cost.

12. Warranty

We warrant that all work will be performed in a workmanlike manner consistent with industry standards in British Columbia. We do not warrant against:

  • Settlement of backfilled areas (some settlement is normal)
  • Drainage performance dependent on soil conditions outside our control
  • Issues caused by your modifications, additions, or third-party work after our completion

Warranty claims must be reported in writing within 30 days of completion.

13. Governing Law

This Agreement is governed by the laws of the Province of British Columbia and is read alongside the All Canadian Website Terms of Use and Privacy Policy. Any disputes will be resolved in the courts of British Columbia.
